GENERAL RULES

All members and guests are personally liable for any damage to the Club.

Eligible guests (those residing outside of Biltmore Shores, Old Harbour Green, New Harbour Green and not on the water side (east) of Ocean Avenue) will be permitted entry to the Facility WHEN ACCOMPANIED BY A MEMBER. Guests must provide proof of address; i.e. driver’s license, registration, etc. During weekdays only, minors who belong to other beach clubs in the area may be admitted to the facility as a guest of BBC members.

The Facility Manager and staff have the authority to enforce all Rules and Regulations. They may restrict facility usage when they believe there is a danger to life or property. Any unseemly behavior will be cause for removal from the facility.

The Facility Manager may restrict facility usage to any member who consistently violates the regulations- Lifeguards may restrict swimming privileges to any member or guest who refuses to observe regulations.

All members must check in with gate guards at the entrance gate and wait to have pictures checked.

Members entering the facility from the Marina with guests must leave their name with the marina guard and proceed to main gate to register their guests.

Report any problems or dangerous situations to the manager on duty immediately.

No glass containers or bottles are permitted anywhere in the facility unless authorized by the Board. We reserve the right to inspect coolers and bags to confirm compliance.

Discretion and responsibility must be observed if using alcoholic beverages in the facility. All alcoholic beverages should be consumed in a discreet manner; please use can holders or plastic cups. Members or guests abusing alcoholic beverages may be asked to refrain from usage or leave the facility.

No animals, bikes, rollerbiades, skateboards, kites, frisbees, or loud radios are permitted in the facility.

Abusive language or actions will not be tolerated.

Please be considerate of our neighbors, their property and privacy.

GATE ENTRY REQUIREMENTS

No member will be admitted without current ID photos.

No member will be admitted who has an incomplete application.

Residents living within the BBC boundaries are not eligible to be admitted as guests. Proof of address is required for admittance. The boundaries consist of South side of Merrick Road, east side of Ocean Avenue, eastern boundary of Harbor Green and South Oyster Bay.

GUEST POLICY

Guest Fees are set by the Board. They currently are: $5.00 a day; 12 Pass books – $50; age 3 and under admitted free.

All guests must enter at Main Gate. Guests entering from Marina must check in at Main Gate.

All Guests must receive a receipt when paying or notify the Manager immediately.

Members must accompany guests into the Club. Members must be present at Club while guests are in Club. Members are responsible for their guests’ actions and their adherence to the rules.

Only members may present guest passes.

Guests may not live within the boundaries of the Club.

Guests are required to provide photo ID with proof of residence.

There shall be no more than 20 adult guests per family on Saturdays, Sundays or Holidays. There shall be no more than 20 adult guests per family on weekdays without prior approval of the Beach and Pool Chairman. No corporate, company or business gatherings are permitted.

BEACH AND POOL

Please refrain from conversation with lifeguards on duty.

Children of any age that unable to swim are not permitted into the facility without competent supervision (age 13 or older) or guardian.

Children under the age of 9 are not permitted into the facility without competent supervision (age 13 or older) or guardian.

A competent supervisor (age 13 or older), parent or guardian must accompany children into the Kiddy Pool. Children over the age of 6 are prohibited from the Kiddy Pool.

Children age 5 or under must be accompanied by a competent supervisor (age 13 or older), parent or guardian within the gated pool area.

Running or roughhousing on the pooi deck is prohibited.

Only one person at a time is allowed on the diving board and in the diving area. Exit the pooi immediately by nearest ladder. No swimming is allowed in the diving area.

Ball playing, floatation devices, swinimies, vests, tubes, toys, etc. are prohibited from the main pool area (except for pre-approved organized activities or swim lessons).

No stroilers or coolers are permitted in fenced pool area.

Food, drink and smoking are prohibited inside the fenced pool area.

Please use lifter baskets and recycling cans.

No dressing or undressing on the beach. Please use the bath house. Deck chairs are not to be removed from the pool deck. Only authorized deck chairs are permitted on the pool deck.

Shorts are not permitted in the pool; swimsuits only.

All children not toilet trained must wear swim diapers when in pool. if an accident happens in the pool, it may have to be closed for an extended period of time.

No diapering anywhere but in the bath houses.

A competent supervisor (age 13 or older), guardian or parent must accompany children under the age of 6 in the playground area.

Pool use will be limited during swimming lessons and other approved events. The swim lap lane is for continuous swimming only. Swim boards and flippers are allowed in lap lane only.

No diving in shallow ends of pool; no jumping into klddy pool.

No towels or clothing should be hung on any fences in the facility.

Parents are urged to discourage children from loitering in the bath houses.

Ashtrays or butt cans must be used when smoking.

Limit time spent in showers and clean up after use in bathrooms.

Kitchen use must be prearranged with manager. Kitchen must be cleaned after each use.

Telephone paging is for emergencies only.

No decoration of the facility is allowed unless it is for a Board sanctioned Club event.

All flyers and posted materials must be Biltmore Beach Club related, inclusive of the general membership, and not be commercial.

BARBECUE AREA

Members must reserve BBQ with manager in increments of one hour to avoid conflicts.

An adult MUST be present at all times.

Make sure the fire is out before leaving area. Clean up area when done.

Members who have reserved a BBQ grill have the FIRST right to use the tables in this area; up to two tables per grill. Please be considerate of others and limit the usage of tables in area to two hours so that others can also utilize the tables for meals.

AWNING AREA AND TABLES

No reserving tables Please be considerate and do not monopolize these tables.

Do not leave towels bags, etc. on tables and chairs when not in use.

If moving tables and chairs together then please return them to their proper place when done.

Clean off tables when done.

BEACH/BAY AREA

During the regular season the bay will be open 10 AM to 7 PM (weather and staffing permitting).

One umbrella per family.

Return umbrella when done.

No white Club chairs are allowed on beach.

Return toys to toy box when done.

No metal shovels, rakes, hoes, etc.

The plastic play sets are for ages 6 and under.

No climbing on or jumping off play sets.

No swimmies, life vests, rafts, etc. are permitted beyond shoreline rope in bay.

You may pass rope to swim to floating dock and back only or for swimming laps.

No rough playing on floating dock.

Clean up area when leaving, and dispose of all trash.

CLUB HOUSE & PARKING AREA

The Clubhouse may be used for group functions that are open to all members (for activities such as SBC Corn mittee meetings and special activities) and are authorized by the SEC Board of Directors.

All social activities must be cleared through the Entertainment Chairperson and posted in the Tidin9s.

No Club property (I.e. tables and chain) may be removed from the Club for personal use.

All activities taking place in the Clubhouse must be cleared through the House Chairperson.

For health and cleanliness reasons, please refrain from using the refrigerator and stove for personal use unless pre-approved by the Facility Manager.

No bare feet or wet bathing suits are pernitted in the Clubhouse at any time.

Any group or committee using the Clubhouse or any other facility has FULL RESPONSIBILITY for cleaning the premises.

The Clubhouse must be closed by midnight and all cars out of the parking lot by 12:30 AM for weekday activities excluding membership and Board activities. On weekends and holidays the Clubhouse must be
closed by 2:00 AM and all cars out of the parking lot by 2:30 AM.

No parking permitted in the driveway east of the Clubhouse. This is an emergency vehicle lane.

All bicycles must be parked in racks in the designated area.

Please be nice to our neighbors. Please do not block our neighbors’ driveways. Please consider and respect our neighbor’s property and privacy as you would want your privacy and property respected. This is especially of concern at the area immediately to the west of the beach entrance gate.

Employees are prohibited from parking in the parking lot.

Do not block cars in the parking lot No triple parking.

MARINA

No boat shall be placed in the marina until all fees are paid and authorized by the Marina Chairperson. No assigned slips will be changed or transferred without authorization of the Marina Chairperson. No subleasing of boat slips will be permitted.

Members are required to immediately notify the Marina Chairperson of the sale or change of ownership of their boats, as well as the purchase of new boats to be placed in the marina.

Four MPH speed limit in the marina.

Boat owners must attend to their boats and shall be responsible for maintaining their boats and be responsible for any damage caused by their boats.

Boats must be removed from the marina prior to December 1. Any boats left as of December 1 will be penalized at a rate established by the Board per day against the member family. The member’s application will not be accepted for membership until the assessment is paid in full.

Members are responsible for keys issued to them. Keys found to be used by non- members, will be confiscated and not returned to the member.

For safety’s sake the marina gate must be locked at all times.

Children under the age of 13 without adult (18 or older) supervision are prohibited from the marina at all times. This rule will be strictly enforced.

Unsupervised children under the age of 15 are prohibited from the marina after sundown unless a marina attendant is on duty (this rule may be waived for children whose parents have received prior authorization from the Marina Chairperson.)

Absolutely no swimming in the marina area.

Absolutely no bicycles, rollerblades or skateboards in the marina.

Boats are prohibited from the beach side swimming area of the marina.

Sailboats may be temporarily (30 minute limit) beached in the boat area immediately adjacent to the marina. Sails must be lowered.

Dogs will not be permitted in the marina unless they are on a leash. Members are responsible for cleaning up after their animals.

Hoses should be replaced neatly on hangers after use.

Electrical outlets can ONLY be used for running vacuums, tools, and battery chargers and ONLY when a member is present. All electrical cords must be properly stowed when not in use.

If your trash cannot be properly disposed of at the marina, then take it home and dispose of it there.

At the end of the season, all lines and moorings are required to be removed from the marina area. Do not leave them for volunteers to clean up.

The fishing pier located on the south end of the marina is the only location where fishing Is permitted. Fishermen are reminded that caution and safety should be exercised at all times.

The fishing pier should be left clean when leaving the area as well as all locations used in the preparation of baiting and cleaning.

Only member’s vessel may use the boat ramp. All members using the marina ramp must purchase and display a BBC ramp sticker on their vessel.

Boats are required to have fenders hanging on both their port and starboard sides where appropriate. This is to protect your neighbors from boat damage.

No materials (tires, carpets, cleats, etc.) may be affixed or attached to the floating docks without prior permission of the Marina Chairman.

The marina may not be used for commercial purposes.

Courtesy dock usage should be limited to 30 minute increments.

Failure to adhere to any of the above rules may result in forfeiture of marina rights as well as possible loss of Club membership.

Zodiacs, canoes, kayaks, wind surfer and rubber rafts must pay fee and be approved by marina committee and assigned an identifying sticker and location prior to season storage. No sticker visible on the vessel, the marina committee will lock it down until proper fee paid. No trailers.

NO MEMBER IS GUARANTEED A SLIP.

Marina Applications:

  1. All applications must be mailed from the BBC to applicants with the regular membership application. Applications cannot be hand delivered prior to the mailing.
  2. All applications must be returned by mail nd postmarked by the deadline date sated on the application along with your first half membership dues. Incomplete applications will be rejected and returned to the applicant, via maiL Resubmitted, complete applications will go in order according to the new postmark.
  3. Registration must be attached. Registration is the paperwork that the state issues an owner. Bill of sale will be considered for application reasons only. Actual valid registration must be submitted prior to docking boat.
  4. Members, who had a slip last year, marina fees must be postmarked by the last day of February with completed application. Fees will be accepted with postmark after last day in February with a $ 100.00 late fee. Any fees received after March 31 will be accepted with a late fee and on a space available basis only. AT THIS POINT YOU ARE SUBJECT TO LOSS OF SLIP.
  5. All new applications must submit a completed application along with a current registration or bill of sale (to be considered for slip assignment only) at this lime to be added to the waiting list.  A check need not accompany this paperwork.
  6. Slip assignment will be assigned as follows:
    A) Members with slips get first preference.
    B) Members with slips who upgrade or downgrade (subject to availability)
    C) Members on the existing waiting list
    D) Members with second boats
    E) Associate members with boats
  7. The postmark is always the deciding factor. In the case of same postmark for existing slip holders, seniority in the marina will prevail. In the case of same postmark for waiting list applications a coin toss will prevai. First letter of last name will be used to determine heads or tails. The letter closer to the beginning of alphabet gets heads.
